ATHLAB360 ONLINE COACHING TERMS

These terms apply to ATHLAB360 Online Coaching. Please read them before purchasing a coaching subscription.

1. Who We Are

Throughout these terms, “ATHLAB360”, “we”, “us” and “our” refer to the provider of the coaching service. “You” and “client” refer to the person purchasing the service.

Where coaching is being provided to a person under 18, the contract must be entered into by their parent or legal guardian.

2. The Coaching Service

ATHLAB360 Online Coaching is an individually programmed remote physical-performance and fitness coaching service.

Depending on the client's needs, the service may include:

  • an initial coaching assessment;

  • individually programmed training;

  • programme delivery through BridgeAthletic or another agreed coaching platform;

  • ongoing programme review and adjustment;

  • review of training information and progress;

  • technique feedback on training videos where appropriate;

  • coaching communication and support through agreed communication channels; and

  • additional coaching consultations where agreed as part of the service.

The precise programme and coaching approach will vary according to the client's goals, training history, sporting demands, available equipment, schedule and other relevant information.

ATHLAB360 does not guarantee any particular sporting, fitness, strength, body-composition or performance outcome.

3. Price and Monthly Subscription

ATHLAB360 Online Coaching is currently charged at £129 per month, unless a different price has been specifically agreed with you in writing.

This is a rolling monthly subscription with no minimum contract term.

The first payment is taken when you subscribe. Further payments are then taken automatically each month using the payment method provided through Stripe.

The price payable before purchase will always be shown clearly at checkout.

If we change the price of your existing subscription in the future, we will tell you before the new price takes effect. You may cancel before the change takes effect if you do not wish to continue.

4. Cancelling Your Monthly Subscription

You may cancel your rolling monthly subscription at any time.

You can cancel by:

  • using the Stripe customer billing portal where available; or

  • emailing hello@athlab360.com and clearly stating that you wish to cancel your Online Coaching subscription.

Unless statutory cancellation rights apply, cancellation will normally take effect at the end of your current paid monthly billing period. You may continue to use the coaching service until that period ends and no further monthly payment will be taken.

We do not normally provide refunds for an unused portion of a monthly billing period where you choose to cancel after the statutory cancellation period. This does not affect any rights you have under consumer law.

5. Your 14-Day Statutory Cancellation Right

When you purchase ATHLAB360 Online Coaching online as a consumer, you normally have a legal right to cancel the contract during the 14-day cancellation period without giving a reason.

The cancellation period begins when the contract is concluded.

To exercise this right, you must clearly tell us that you wish to cancel. You may do this by emailing hello@athlab360.com or by using the model cancellation form at the end of these terms.

You do not have to use the cancellation form.

If you cancel before the coaching service has begun, any payment due to be refunded will be refunded in accordance with your statutory rights.

6. Starting Coaching During the 14-Day Cancellation Period

You may ask ATHLAB360 to begin providing your coaching service before your statutory 14-day cancellation period has expired.

If you expressly request that coaching begins during that period and subsequently exercise your statutory right to cancel, you may be required to pay an amount proportionate to the coaching services supplied up to the date you tell us you are cancelling.

You will be given the opportunity to choose whether you want your coaching to begin immediately or after the statutory cancellation period.

7. Coaching Start and Programme Delivery

Your coaching programme will be prepared after:

  • your coaching application and assessment have been completed;

  • any information requiring clarification has been discussed;

  • payment has been completed; and

  • you have been accepted for coaching.

We will either agree a start date with you or make the initial programme available within a reasonable period after the required information has been received.

Training may be delivered through BridgeAthletic or another platform selected by ATHLAB360.

Temporary technical problems affecting a third-party platform will not automatically constitute a failure to provide coaching, provided we take reasonable steps to restore or provide alternative access where appropriate.

8. Health, Injury and Medical Information

ATHLAB360 provides physical-performance, strength and conditioning and fitness coaching. It does not provide medical diagnosis or treatment.

You are responsible for providing accurate and relevant information about injuries, medical conditions, medication, restrictions and other matters that may affect your ability to train safely.

You must tell ATHLAB360 if your health, injury status or circumstances materially change during coaching.

If you experience unexpected or concerning pain, illness, dizziness, chest pain, loss of consciousness or other symptoms that may require medical assessment, you should stop training and obtain appropriate medical advice.

Where appropriate, ATHLAB360 may recommend that you obtain clearance or advice from an appropriately qualified healthcare professional before beginning or continuing particular training.

9. Client Responsibilities

To allow us to provide the coaching service effectively, you agree to:

  • provide accurate information during assessment and throughout coaching;

  • inform us of relevant changes to your health, injuries, training schedule, sporting commitments or available equipment;

  • complete training in an appropriately safe environment;

  • use training equipment appropriately;

  • follow coaching instructions and prescribed progressions with reasonable judgement;

  • report significant pain, injury or adverse responses to training; and

  • communicate honestly about training completed and feedback relevant to programme decisions.

You remain responsible for your decisions when training independently.

10. Under-18 Coaching

Where the person receiving coaching is under 18, the purchaser must be their parent or legal guardian unless another legally appropriate arrangement has been agreed.

The parent or guardian is responsible for providing the necessary consent and relevant information and for making payment.

ATHLAB360 may apply additional communication, safeguarding and supervision requirements when coaching a person under 18.

Nothing in these terms overrides ATHLAB360's safeguarding responsibilities.

11. Coaching Communication

Online Coaching includes reasonable coaching communication relating to your programme.

It is not an emergency, medical or 24-hour support service.

ATHLAB360 will aim to respond to coaching enquiries within a reasonable time, taking account of weekends, holidays, coaching commitments and other circumstances.

12. Intellectual Property

Training programmes, written materials, coaching resources, videos, documents and other materials supplied by ATHLAB360 remain the intellectual property of ATHLAB360 or the relevant rights holder.

Your coaching programme is supplied for your personal use.

You must not sell, publish, distribute, reproduce commercially or provide your ATHLAB360 programme or paid coaching resources to another person without permission.

13. Data and Privacy

ATHLAB360 will process personal information in accordance with its Privacy Policy and applicable data-protection law.

Information provided for coaching purposes may include training, health and injury information where relevant to delivering the service.

Our Privacy Policy is available on the ATHLAB360 website.

14. Our Responsibilities

ATHLAB360 will provide the coaching service with reasonable care and skill.

Nothing in these terms excludes or restricts any liability which cannot lawfully be excluded or restricted, including liability for death or personal injury caused by our negligence.

Nothing in these terms removes or reduces your statutory consumer rights.

ATHLAB360 is not responsible for losses that were not reasonably foreseeable or that were not caused by a breach by ATHLAB360.

15. Suspending or Ending Coaching

ATHLAB360 may suspend or terminate coaching where there is a legitimate reason to do so, including:

  • non-payment;

  • abusive, threatening or inappropriate behaviour;

  • misuse of coaching materials or platforms;

  • circumstances in which we reasonably believe continuing the coaching relationship would be unsafe; or

  • a serious or repeated breach of these terms.

Where ATHLAB360 ends a paid coaching period without a breach by the client, any appropriate refund for services not supplied will be considered in accordance with the circumstances and applicable consumer law.

We will aim to investigate and resolve complaints fairly and within a reasonable time.

17. Changes to These Terms

We may update these terms from time to time.

Changes will not retrospectively remove rights you already have under an existing paid coaching period.

Where a material change affects an ongoing subscription, we will provide reasonable notice before it takes effect.

18. Governing Law

These terms are governed by the laws applicable in England and Wales.

Nothing in this section affects any mandatory consumer right you may have to bring proceedings in another part of the United Kingdom where applicable.
